The practice covers the full IP lifecycle—identification and clearance, registration, portfolio strategy, commercialization, and enforcement—while coordinating IP issues with contracts, competition rules, and emerging-technology risks. In the digital ecosystem, we guide clients through online infringement, platform takedowns, domain and social-handle disputes, and privacy/data-protection issues that overlap with IP ownership and exploitation.
Contracts
The team drafts and negotiates IP-centered agreements that clearly allocate ownership, control, and revenue—licenses (exclusive/non-exclusive), joint-development and co-ownership deals, distribution and publishing agreements, SaaS and software-use terms, technology-transfer arrangements, R&D collaborations, and influencer/creative-content contracts.
The team also stress-tests contracts for enforcement risk, designing dispute-resolution clauses and practical remedies (injunctive relief, escrowed source code, step-in rights) to protect value if a deal breaks down.
Privacy, Cybersecurity, Social Media and Digital Workplace
The firm advises on privacy and cybersecurity compliance that intersects with IP and digital assets, including applicable frameworks such as GDPR (where relevant), Puerto Rico data-protection statutes (e.g., Act No. 159 of 1999), and HIPAA/HITECH for healthcare-related entities. We handle trademark clearance, registration, and enforcement locally in Puerto Rico and federally through the USPTO, helping clients select, refine, and protect distinctive brands. Services include searches, filing and prosecution, opposition/cancellation proceedings, renewals, and portfolio rationalization across product lines and jurisdictions.
Brand enforcement ranges from monitoring and demand letters to litigation, including actions against counterfeiters, gray-market imports, confusingly similar marks, and online impersonation. The team also supports international protection through Madrid Protocol filings, negotiates trademark licensing and coexistence agreements, and resolves domain-name and handle disputes (including UDRP-style processes) to keep brands secure in both physical and digital markets.
